Terms of Service and Engagement Parameters

Acceptance of Terms

By utilizing the Indaba Forensic Services website, submitting a secure intake inquiry, or formally engaging our intelligence unit, clients and instructing attorneys agree to be bound by these operational parameters.

Scope of Services and Triage Consultations

Indaba Forensic Services provides specialized litigation support, forensic data architecture, and discrepancy detection.

  • Initial Triage: An initial 15-minute triage consultation to assess case viability and data parameters is complimentary.

  • Advisory Consultations: Should a matter require in-depth strategic advisement or mandate scoping prior to formal forensic ingestion, these consultations are billed at an hourly advisory rate.

Phased Flat-Fee Investment Structure

To provide budget predictability, substantive forensic analysis is conducted in sequential phases.

  • Phase 1 (Data Ingestion & Initial Assessment): Fixed fee covering AI-driven tools to parse initial discovery batches and generate a high-level discrepancy summary.

  • Phase 2 (Deep Forensic & Tracing Analysis): Fixed fee covering in-depth investigation of flagged entities and chronological money trails.

  • Phase 3 (Litigation Readiness & Joinder Support): Fixed fee covering the finalization of strategic exhibits, including the Evidence Matrix and Joinder Master List.

  • Note: Progression to subsequent phases requires explicit authorization. Fees exclude VAT and external disbursements.

Data Volume Parameters and Hostile Data Dumps

The fixed-fee structure is strictly predicated on the provision of standard, indexed, and reasonably structured discovery documentation.

  • Trigger for Hourly Triage: In the event that discovery is provided in a voluminous, unindexed, or deliberately unstructured format (including bulk image-only PDFs or hostile data dumps), substantive forensic analysis under the flat-fee arrangement is immediately paused.

  • Technical Processing: The optical character recognition (OCR) and structural formatting required to integrate unstructured data into the IndabaOne database will be billed at our standard technical triage hourly rate until the data is deemed structured and interrogatable.

Information Collection and Ingestion

We process highly sensitive information derived from comprehensive High Court discovery and disclosure procedures. This includes, but is not limited to: General Discovery (Rule 35(1)), Production of Documents in Pleadings (Rule 35(12)), Inspection and Copying (Rule 35(6)), Notices to Produce at Hearing (Rule 35(10)), Medical and Expert Examinations (Rule 36), the Authentication of Documents executed outside the Republic (Rule 63), and specialized Financial Disclosure Forms (FDF) mandated by High Court Practice Directives for Rule 43 interim relief applications, financial statements, corporate registry details, and digital communications. Data is collected exclusively through our encrypted Microsoft Azure-hosted portal, following explicit mandate authorization by the instructing attorney or client.

Reliance on Client Data

Our forensic findings are entirely dependent on the completeness and accuracy of the data provided during the discovery process. Indaba Forensic Services accepts no liability for discrepancies arising from documents deliberately withheld or obscured by opposing parties. All internal system tracking and communications will reference the designated Case No. and Client Ref. No. to ensure strict administrative boundary control.
